§1. General provisions
1. These Terms and Conditions (the "Terms") set out the rules for using the web page available at www.wedesign.pl/brandboost (the "Page"), including the rules for providing services by electronic means through it, in accordance with Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
2. The service provider and operator of the Page is We Design Studio Graficzne Aleksander Rokicki, with its registered office in Warsaw (01-560), ul. Toeplitza 2/48, Poland, tax ID (NIP) 951-184-66-07, e-mail: studio@wedesign.pl, tel. +48 728 177 980 (the "Service Provider").
3. The Page serves to present information about the "Brand Boost 2027" project (the "Project") and to accept applications to the Project via the application form.
4. The rules of participation in the Project – including the eligibility conditions, the selection criteria and procedure, the scope of the Service Provider’s performance and copyright – are set out in the separate Brand Boost 2027 Project Rules available on the Page (the "Project Rules"). These Terms do not amend the Project Rules; in the event of any discrepancy regarding the rules of the Project, the Project Rules prevail.
5. The rules for processing personal data and using cookies are set out, respectively, in the Brand Boost 2027 Privacy Policy and the Cookies Policy, both available on the Page.
6. Using the Page constitutes acceptance of these Terms. The Terms are made available free of charge in a manner that allows them to be obtained, reproduced and saved.
§2. Definitions
- User – any person using the Page;
- Applicant – an entity conducting business or professional activity on whose behalf the User completes and submits the Form;
- Form – the electronic application form for the Project made available on the Page;
- Services – the services provided by electronic means through the Page, described in §3.
§3. Types and scope of services provided by electronic means
1. Through the Page, the Service Provider provides the following Services free of charge: (a) making information about the Project available; (b) enabling the User to complete and submit the Form.
2. The information service is provided from the moment the User enters the Page until they leave it. The Form service is provided from the moment the User starts completing the Form until it is submitted, or until the browser tab is closed or the Page is left without submitting.
3. Submitting the Form constitutes an Application within the meaning of the Project Rules. Submitting the Form does not conclude any agreement to carry out the Project and does not oblige the Service Provider to select the Applicant – in accordance with §4(5) of the Project Rules.
4. After submitting the Form, the User will see a confirmation message on the Page and receive an automatic e-mail confirming receipt of the Application. If no confirmation arrives within 24 hours, the Application may not have been received – in that case please contact us at studio@wedesign.pl. Before contacting us, please check whether the message has landed in your spam folder.
§4. Technical requirements
1. Using the Page requires: a device with Internet access, an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled and – to submit the Form – an active e-mail account.
2. The Form requires the browser’s session storage (sessionStorage) to be enabled; it is used solely to temporarily keep the answers entered on the User’s device (see the Cookies Policy for details).
3. The Service Provider makes every effort to keep the Page available without interruption but reserves the right to temporary technical breaks. Where possible, the Service Provider will announce planned breaks during the application period on the Page.
§5. Rules for using the Page and the Form
1. The Form may only be submitted by a person authorised to act on behalf of the Applicant. By submitting the Form, the User declares that they hold such authorisation and that the Applicant meets the eligibility conditions set out in §3 of the Project Rules, in particular that it acts as a business or organisation and not as a consumer.
2. The User is obliged to provide true, up-to-date and complete information in the Form. Providing false information may result in the Application being disregarded.
3. Each Applicant may submit one Form only (§3(5) of the Project Rules). If the same entity submits several Forms, the Service Provider will take into account the most recent Application.
4. The User is prohibited from providing unlawful content, in particular content that infringes third-party rights or personal rights, contains malicious software or is intended to disrupt the operation of the Page. Using the Page in an automated manner (bots, scripts submitting the Form in bulk) and attempting to gain unauthorised access to the Service Provider’s systems are also prohibited.
5. When providing personal data of other persons in the Form (e.g. team members), the User warrants that they are entitled to do so and have informed those persons that their data will be provided to the Service Provider.
6. The Service Provider may disregard an Application or block access to the Form in the event of a breach of these Terms or the Project Rules, and may remove unlawful content.
§6. Conclusion and termination of the agreement for the provision of Services
1. The agreement for the information service is concluded when the User enters the Page and terminates when they leave it.
2. The agreement for the Form service is concluded when the User starts completing the Form and terminates when it is submitted or when the User stops completing it (closing the tab, leaving the Page). Data entered in a Form that has not been submitted is not sent to the Service Provider.
3. The User may stop using the Page at any time. An Application may be withdrawn after submission by sending a message to studio@wedesign.pl.
§7. Intellectual property
1. All content on the Page, in particular texts, graphics, logos, layout, photographs and the projects presented, is subject to the rights of the Service Provider or its clients and is protected under the Polish Act of 4 February 1994 on Copyright and Related Rights and other applicable laws.
2. The content of the Page may be used solely for personal purposes, in order to learn about the Project. Copying, distributing, modifying or otherwise using the content of the Page for commercial purposes without the Service Provider’s written consent is prohibited.
3. Third-party trademarks and logos presented on the Page (e.g. in the portfolio) belong to their respective owners.
4. Rights to the materials provided in the Form remain with the Applicant. The Service Provider uses them solely to consider the Application and carry out the Project, in accordance with the Project Rules and the Privacy Policy.
§8. Liability
1. The Service Provider makes every effort to keep the information on the Page up to date and accurate; however, it is provided for information purposes only. The binding rules of the Project are set out in the Project Rules.
2. The Service Provider is not liable for non-delivery or delayed delivery of the Form due to causes attributable to the User or their Internet service provider, nor for the consequences of providing false or incomplete information in the Form.
3. The Page may contain links to external websites (e.g. LinkedIn, Instagram). The Service Provider is not responsible for the content or operating rules of those websites.
4. To the fullest extent permitted by law, the Service Provider’s liability towards Users who are not consumers in connection with the use of the Page is limited to actual loss caused by wilful misconduct.
§9. Complaints
1. Complaints regarding the operation of the Page or the Services may be submitted by e-mail to studio@wedesign.pl or in writing to the Service Provider’s registered office.
2. A complaint should include information enabling the identification of the User or the Applicant, a description of the problem and – where possible – the date it occurred, the browser used and the type/model of device.
3. The Service Provider will consider complaints within 14 days of receipt and reply to the e-mail address from which the complaint was sent or to the postal address indicated.
4. The complaints procedure does not apply to the decision on the selection of the Project Participant, which – in accordance with §5(3) of the Project Rules – is final and not subject to appeal.
§10. Final provisions
1. The Service Provider may amend these Terms for important reasons, in particular in the event of changes in the law, changes to the functionality of the Page or organisational changes. The amended Terms apply from the date of their publication on the Page. Applications submitted before the amendment are governed by the Terms in force on the date of submission.
2. These Terms are governed by Polish law. These Rules are drawn up in English.
3. Disputes with Users who are not consumers shall be resolved by the court having jurisdiction over the Service Provider’s registered office.
4. These Terms enter into force on 16 September 2026.
